When it comes to the truck bed specifically, state law draws a firm line at age 15: kids younger than that generally cannot ride in the open bed or cargo area of a pickup or trailer.
That said, the law carves out several exceptions. A child may legally ride in the bed if:
- An adult is present in the bed supervising them.
- They're buckled into a federally approved child safety seat rated for the load.
- The truck is part of a permitted parade or hayride.
- An emergency situation calls for it.
- The trip is related to hunting or farm work.
- The vehicle is in a county with no incorporated area over 3,500 people.
- The truck has a closed metal tailgate and stays under 36 mph.
